While the most common trusts are of the express or constructive trust forms, other types of trusts do exist.

A fixed trust is one where the amount that the beneficiaries are entitled to is determined beforehand by the settlor. The trustee has no right to determine these amounts. The settlor can determine how the beneficiary is to receive his or her money. For example, the beneficiary can receive a fixed amount once they reach a certain age. Or they may receive a certain amount of money periodically. Such decisions are taken by the settlor himself.

A hybrid trust is a combination of a discretionary and fixed trust. While the trustee is expected to pay a certain fixed amount of money to the beneficiary, he can determine what to do with the remaining money, if there is any.

An incentive trust is one which allows the trustee to make distributions from the income generated by the trust assets to encourage the beneficiaries to act or behave in a certain fashion. The trustee can decide for himself whether the beneficiary deserves to receive any money at all.

An offshore trust is one which is under the jurisdiction of a law establishment other than the one which the settler is residing up on. This term is more commonly known as tax haven. While the concept of the trust is identical to that of the onshore trust, this is a commercially viable option as the laws of the other country may be more lenient as compared to the ones in the country in which the settlor is residing.

One such trust is a Constructive trust. This type of trust is implemented by the law as a remedy in certain situations. This is not a trust that can be created between a trustee and a donor. The trustee of such a trust is generally a bank , and not a single person.

A dynasty trust is another trust that is created for the benefit of the creator’s grandchildren, and not his own children. The donor’s children do not get the rights to the asset. This trust is generally created to avoid paying the taxes that are required to be paid if the donor made his own children the beneficiaries. The donor’s children can still receive certain financial benefits however. Any income that is made by the assets of the trust are accessible to the children of the donor, even though technically the trust was created to benefit the grandchildren of the donor.

When a donor deliberately decides to create a trust of his assets in the event of his death, an express trust is created. The trust can be created by signing a trust deed or a will. Most of the trusts that are created are of this type. However, such a trust needs to be approved by a law organization, otherwise it is meaningless. This is done to prevent cases of fraud. The settlor is required to provide proof that he is in possession of the assets that he intends to add to the trust. He should also be able to prove his intention of creating such a trust.
